Would you please supply the following information:

1.  Please confirm that during its correspondence with xxxxxx, the Ordnance Survey was unaware that xxxxxx Council had served a Remedial Notice on xxxxxx under the Anti-Social Behaviour Act 2003 to reduce the height of 100ft Leylandii trees close to a boundary.

2. Under the Freedom of Information Act we request copies of all correspondence between xxxxxx and the Ordnance Survey between February and June 2010.

3.  Also, please supply a copy of the Ordnance Survey Management Structure.

Thank you for your letter dated 24th June 2010. Please note, that not all the information you have requested has been supplied with this response.  Some of the information falls under an exemption of the Freedom of Information Act 2000 (FOIA), or is subject to the Data Protection Act 1998. Where information has not been supplied, the reasoning is detailed against the applicable question.

In response to your questions:

1. Ordnance Survey was aware that xxxxxx had been issued with a Remedial Notice however, we were not aware of the Act under which this was issued. Please be aware that our knowledge of this Notice has had no bearing on the way Ordnance Survey has dealt with this matter. Throughout this investigation, it has been Ordnance Surveys aim to accurately reflect the position of the administrative boundary between xxxxxx and xxxxxx.

2. We are unable to release the information you have requested in your question two, as this fall under the Data Protection Act 1998.

3. Following my clarification telephone conversation with xxxxxx on Friday 2nd July 2010, I understand that by asking for a copy of Ordnance Surveys management structure, you would like a structure diagram detailing the job title and names of those persons who have been involved with your matter from operational level upwards to date, which we enclose with this letter.

Please note that not all of the information you have requested to be provided on this structure diagram has been.  Some of the information falls within Section 40 (2) (a), Personal Information.  We believe this exemption applies, because there is an expectation that the names of staff working for Ordnance Survey will not be released, unless this information is already in the public domain.

Please note that your enquiry has been processed to Freedom of Information guidelines.  As all of the requested information we hold in your question one has been provided, we have determined that the Public interest consideration (section 17 FOIA) is not applicable in this instance.

The information provided in your question three, is subject to the exemption detailed above, and we have determined that the Public Interest consideration (section 17 FOIA) in withholding this information, does outweigh that of disclosure.
