Please could you provide the data requested in the attached document (Tender pricing table)?

Thank you for your e-mail dated 26th October 2010.

Under the Freedom of Information Act we note your request was for Ordnance Survey to provide you with details of the highest and lowest priced winning contractor bids per Square Km (England and Wales) for both Ordnance Survey IPR and retained IPR.

I can confirm that Ordnance Survey does hold this information, however I regret to inform you that your request falls within the Commercial Interests exemption under section 43 (2) of the Freedom of Information Act (FOIA) 2000.

We believe this exemption applies because as you will already be aware, Ordnance Survey is currently re-tendering for the ‘Request for data supply and maintenance contract’ and the release of the requested information to you could be contrary to established protocols and legislation concerning the conduct of publicly tendered procurements.

To the extent that the Public interest test applies (section 17 FOIA), we have determined there is public interest in ensuring that Ordnance Survey tenders are conducted within the protocols and legislative requirements concerning publicly tendered procurements, whereby companies are able to compete fairly, and there is public interest in ensuring that there is competition for public sector contracts. Therefore we have determined the public interest in withholding this information outweighs that of disclosure on this occasion.
