I refer to your recent telephone conversation with my colleague Peter Standen, requesting the following information under the Freedom of Information Act (FOIA) 2000:
‘Is Ordnance Survey minded to take legal action against local authorities to compel them to honour their obligations under the NLPG contract?’
I regret to inform you that Ordnance Survey is unable to help you with your enquiry as we do not hold recorded information in relation to this.
Under Section 16 of the FOIA, the duty to provide advice and assistance, I am able to advise that Ordnance Survey is not conducting any live contractual enforcement action against local authorities in relation to NLPG, but as with any licensee would have to consider the taking of such action as may be necessary in circumstances where the licensee is operating outside the permitted terms of its licence.
