Thank you for your e-mail of 10th February 2012, requesting:
'I am writing to obtain details of the use of powers of entry by your authority under any of the relevant Acts or items of secondary legislation during the period 2008 - 2011, excluding Trading Standards investigations. I wish to obtain details of:
. how many times such powers were used in the past three years,
. the legislation they were requested under
. the criminal offence or allegation being investigated
. the outcome of their use, if any.'
Powers of entry onto land and property are provided to officers of Ordnance Survey within the Ordnance Survey Act of 1841 as amended. These powers are intended solely to enable Ordnance Survey to take the ground measurements and observations of the topography and built features of the landscape, necessary to compile and maintain its mapping.
Ordnance Survey seeks to work in co-operation and collaboration with land owners and occupiers in order to conduct the work of the survey with the consent of land owners and occupiers.
As a consequence, it has not been necessary to resort to the use of statutory powers of entry in the period 2008 to 2011, therefore the information you have requested under the above four points is not held.
