Request for Information – FOI12330

Thank you for your e-mail of 4th October 2012, requesting the following information under the Freedom of Information Act (2000) FOIA:

‘Can you please clarify the apparently contradictory replies give to Freedom of Information requests referenced 71979 and 72267’

I confirm that Ordnance Survey does hold this information. 

Firstly, the response we have previously issued under FOI request 72267 is correct.  Crown copyright is retained for 50 years from the end of the year in which the mapping (or amended version) was published. 

Our response under FOI request 71979 also correctly details and confirms this same copyright information.  However, in the example used, as it was suggested the map was reprinted with minor changes in 1965, copyright applies from the reprinted date, therefore 50 years would be to the end of the 2015 calendar year, meaning copyright will lapse on 1st January 2016.

The FOI Appeals Officer will either: uphold the original decision, provide additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
