Thank you for your e-mail of 26th October 2012, which we acknowledge, requesting:

‘I would like to know why I was not successful this time, given that my skill set is beyond capable of the job description in the xxxxxx role. I understand that you had a large number of candidates who applied, and that being a public body you would have scored them each individually. I would like to know why my application was not successful since it would greatly help any future applications.

I might remind you that you must give me this information under the Freedom of Information Act.’

I confirm that Ordnance Survey does hold the information you have requested, but we consider this information to be exempt from disclosure under Section 40 (1) of the Freedom of Information Act (FOIA) 2000 – Personal Information.

This is because personal data of the requester is not covered under Freedom of Information, but is dealt with in accordance with the Data Protection Act (DPA) 1998.

Under Section 16 of the FOIA the duty to provide advice and assistance, we have transferred your request to our Data Protection Team, who will consider your request and contact you directly.

Public Interest
Section 40 (1) of the FOIA is an absolute exemption therefore there is no public interest case to consider.

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The FOI Internal Review Officer will not have been involved in the original decision. They will conduct an internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance. 

The FOI Internal Review Officer will either: uphold the original decision, provide additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
