Thank you for your e-mail 19 February 2013, requesting:
Please can you let me know the most accurate estimate that you hold of the height of the terrain (excluding any objects such as trees or buildings) above Ordnance Datum at either:
(i) grid reference SU 50512 97453 (hereafter point "A"), or
(ii) points surrounding A for which you hold accurate elevation data, from which the elevation at A can reasonably be estimated by interpolation – for example if you have gridded Digital Terrain Model data then the vertices of the grid cell containing A – stating their locations.
I confirm that Ordnance Survey does hold this information, however, your request falls within the ‘Information accessible to applicant by other means’ exemption under Section 21 of the Freedom of Information Act (FOIA) 2000.
We consider this exemption applies because the requested information is available to the public, as a licensed data product from Ordnance Survey called Land-Form PROFILE®.
Whilst there will be a cost to obtain licensed data, section 21 (2) (a) of the FOIA advises that information may be considered reasonably accessible to the applicant even though it is accessible only on payment.

Section 21 is an absolute exemption and no public interest test is applicable.

The FOI Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.
The FOI Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
