Legal boundary disclaimer

Request for information – FOI13364

Thank you for your e-mail of 20 March 2013, requesting:

We’re still unclear about the statement from Ordnance Survey “Please note that Ordnance Survey mapping does not depict legal property boundaries nor do we attempt to show property ownership on our mapping”.

But Ordnance Survey plans are used by Act of Parliament when drawing up Land Registry Plans that can only be changed by mutual consent of the owners of the properties once registered with the Land Registry; please can you tell us how this relates to the above statement?

I confirm that Ordnance Survey does hold the information you have requested, however this information is exempt under Section 21 of the FOIA – Information Accessible to applicant by other means. The reason this information is exempt is because it is already published, on our website, and therefore available on our property boundaries FAQs page.

The various questions regarding boundaries, on this web page, can be opened to provide the answer to your question and other boundary-related issues.

Under the duty to provide advice and assistance, Section 16 of the FOIA, we also draw your attention to our property boundaries web page which will provide you access to a joint statement from Land Registry and Ordnance Survey regarding property boundaries, which may be of interest.

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The FOI Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The FOI Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
