Wi-fi contract

Request for information – FOI13410

Thank you for your e-mail of 3 September 2013, requesting information from Ordnance Survey in accordance with the Freedom of Information Act (FOIA) 2000.

Ordnance Survey does hold some of the information to respond to your information request. Where information is not held or exempt from disclosure, this is detailed.

We respond to each of your questions as follows:

Section one

1. Wi-Fi Provider – Who is the contracted supplier for the Wi-Fi contract?

2. Average annual spend – Please state the annual average spend over three years for each supplier. If this is a new contract please state the estimated annual average spends. If there is more than one Wi-Fi provider please split annualy for each individual provider.

The contact details for the person responsible in the organisation for the Wi-Fi is exempt from disclosure as we consider this information to constitute personal data and therefore engage Section 40 (2) of the FOIA, which is an absolute exemption.

Section 40 (2)(a) and (b), together with the condition under section 40 (3) (a) (i) of the FOIA, apply where the disclosure of information would contravene any of the data protection principles under the Data Protection Act (DPA) 1998. These sections exempt information constituting the personal data of living individuals, the release of which would be in breach of the Data Protection Principles.

In applying this exemption, we have considered whether disclosure of the personal data in question would be 'fair' (as described in Schedule 1 of the Data Protection Act). We have given particular consideration to the likely expectations of the data subject regarding the disclosure of the information. We have reached the conclusion that disclosure of a job title in this case would not be 'fair', given that the individuals concerned are not Senior Civil Servants (SCS), and that there is no expectation for junior employees to have information which would identify their actual salary made publicly available.

As all the requested information has been provided, is not held or is exempt under an absolute exemption of the FOIA, we have determined that in all the circumstances of this case the Public interest consideration (section 17 FOIA) is not applicable in this instance.
