Under the Freedom of Information Act we request the following information:

1.How many staff employed by Ordnance Survey have accrued more than the permitted 14 hours and 48 minutes to their flexi-time clock as at 4 April 2014 – broken down into work area and grade/zone (provided this does not compromise anonymity).

2.How many hours each member of staff who fits the above criteria (without names) has accumulated above the permitted allowance.

Our response

Thank you for your email of 9 April, requesting the following information in accordance with the Freedom of Information Act (FOIA) 2000:

1.How many staff employed by Ordnance Survey have accrued more than the permitted 14 hours and 48 minutes to their flexi-time clock as at 4 April 2014 –broken down into work area and grade/zone (provided this does not compromise anonymity).

2.How many hours each member of staff who fits the above criteria (without names) has accumulated above the permitted allowance.

I regret to inform you that Ordnance Survey is unable to help you with your enquiry as we do not hold this information.

The reason we do not hold this information, is because it is not possible to access information relating to a past date within Tenrox, only for the current and future dates as we reach them.

Your request stipulates that you require this information as at 4 April 2014, and your request was submitted on 9 April 2014. It would not have been possible to provide the information you have sought at any time following receipt of your request.

Under Section 16 of the Freedom of Information Act ‘the duty to provide advice and assistance’ we remind you that Ordnance Survey does not have a mandatory time recording system. Some employees record time worked and/or flexi-time locally by agreement with their line manager. Consequently it would not be possible to provide information relating to all staff employed by Ordnance Survey – even upon selection of a future date.

Whilst flexi-time information relating to individuals who chose to use Tenrox may be correctly or incorrectly held (depending on the local agreement for use of the system) it cannot be extracted by work area and/or grade/zone.

The Freedom of Information Act is to make provision for the release of information which is ‘held’ by an authority, with there being no requirement to create information for the purpose of responding to an information request, as would be the case in this instance for information by area, grade, zone.

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The FOI Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The FOI Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
