Request

Thank you for your email of 24 December 2015, requesting the following information in accordance with the Freedom of Information Act (FOIA) 2000:

1. The number of emails between XXXXXXXX XXXXX and Jon O’Meara since 1 Sept 2015 specifically and only concerning “77m not being allowed to produce any products utilising in part or whole INSPIRE polygons, even when these products do not actually include the polygons or the polygons’ associated geometry”.

2. The dates and times of these emails.

3. The content of these emails the publishing of which we believe is in the public interest as well as partner interest.

Our response

I am writing to advise you as follows:

1. This information is not held as there are no emails which specifically and only concern 77m not being allowed to produce any products utilising in part or whole INSPIRE polygons, even when these products do not actually include the polygons or the polygons’ associated geometry.

However, under our duty to provide advice and assistance as stipulated in Section 16 of the FOIA, we would advise that we do hold emails which include discussion concerning licensing implications in the event that 77m Ltd has derived points using OS geometry contained in LR polygons; however, please note that it is likely that the content in these communications would be exempt under S42 (1) of the FOIA ‘Legal Professional Privilege’ in any event.
