Our response

Thank you for your letter of 31 July 2018, with enclosures (LR title plan and Google Earth Imagery), following on from your original request for infomation (FOI18841), requesting information from Ordnance Survey in accordance with the Freedom of Information Act (FOIA) 2000.

I confirm that Ordnance Survey does hold some of the information you have requested. Our responses are set out below to the relevant questions from your letter, taking the original numbering from your letter.

6. I would be grateful if you would explain:
a) Why the previous tree cover of the land is not recorded on the Land Registry title plan?

Whilst this does not appear to be a valid request for recorded information under Section 8 of the FOIA, we are happy to provide the following explanation in accordance with our duty under section 16 of the FOIA to provide advice and assistance.

Ordnance Survey mapping forms the basis of Land Registry Title Plans. The Title Plan is based on the current OS mapping at the time of First Registration with Land Registry and therefore reflects the features on the ground at that time.

Please note that subsequent changes that have occurred on the ground since a property is first registered may result in differences between later Ordnance Survey map editions and the mapping used by HM Land Registry for the Title Plan.

You may also wish to contact Land Registry for further information in relation to the features depicted on their Title Plans.

b) Why the existing tree canopy to the west of the site along PROW 345 is not recorded on the Land Registry title plan?
Whilst this does not appear to be a valid request for recorded information under section 8 of the FOIA, we are happy to provide the following explanation in accordance with our duty under section 16 of the FOIA to provide advice and assistance.

In relation to Ordnance Survey mapping the line of trees along the PROW 345 is not depicted in our mapping as it does not meet the specification for capture. The minimum area size for showing an area of trees on our mapping, at this scale (1:1250) is 0.1 hectares with a minimum width of five meters, therefore the area of trees you refer to is too small to be shown in MasterMap. Typically, the measurement is made to the trunks not the canopy of the trees. Historically most of our capture was carried out by ground survey. The edge of woods/edge of areas of trees is taken as the point where the trunks/ground level feature begins, and the overhanging canopy ignored.

7. And, also:
a) When the dotted line was added to the Mastermap?
The ‘dotted line’ you refer to was added on 8.12.2015.

b) Who was responsible for adding the dotted line to the MasterMap and, consequently, for its inclusion on the Land Registry title plan?
Ordnance Survey production.

c) How the edge of the tree canopy (delineated by the dotted line on the Land Registry title plan) was surveyed?
The dotted line you refer to was surveyed from aerial photography as part of our cyclic revision programme.

d) Who, or what organisation, surveyed the tree canopy and its southern limit (the dotted line)?

8. I would also be grateful if you would send me a copy of the area on the Ordnance Survey MasterMap used by the Land Registry to draw up title plan XXXXXX and its tree canopy?

Or, alternatively, if you could explain to me how I can acquire a copy of the MasterMap used by the Land Registry to delineate title plan XXXXXX?
Ordnance Survey is unable to provide a copy of Ordnance Survey MasterMap used by Land Registry for Title Plan XXXXX. As explained in our response to 6a) the Land Registry Title Plan will have been based on the OS mapping at the time the property was first registered with Land Registry, Ordnance Survey does not have details of when your property was first registered with Land Registry.

I can confirm the area which forms title XXXXX has not been through any survey since 2015 when the ‘dotted line’ referred to in your request was added to MasterMap therefore, there have been no further updates to the area and MasterMap currently reflects that which is shown on Title Plan XXXXX.

However, if you do wish to obtain a copy of the current edition of MasterMap this can be purchased through one of our mapping agents. A list of all mapping partners can be found on our find the right OS Partner web page.

The Internal Review Officer will not have been involved in the original decision. The Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
