Thank you for your email of 16 February 2018, requesting information from Ordnance Survey in accordance with the Freedom of Information Act (FOIA) 2000, as set out in the extract below:
1. The full inspection report from Ordnance Survey with its precise measurements and GPS readings of the physical boundary detailing the exact position on the ground of the westernmost boundary of Title Register Number XXXXXX as carried out by your surveyor – XXXXX XXXXX on XX XXXXXX XXXX.
2. The conclusions reached in the survey report and full details of the associated mapping changes made to the previous existing title plan in order for the OS/HMLR to produce the revised title plan (dated XX XXXXXX XXXX) following your Surveyor’s visit on XX XXXXXX XXXX."
I confirm that Ordnance Survey does hold a copy of the survey report, however, we are unable to comply with your request and provide a copy of the information, as we consider the information to be exempt from disclosure under section 21 of the FOIA. This is because the information is accessible to you, as it is already in the public domain, with HM Land Registry.
S21(2)(b) of the FOIA states that information is reasonably accessible if "it is information which the public authority or any other person is obliged by or under any enactment to communicate (otherwise than by making the information available for inspection) to members of the public on request, whether free of charge or on payment." This means that section 21(2)(b) of the Act applies to your request.
Section 21 is an absolute exemption therefore no public interest test is applicable.
Ordnance Survey do not hold information relating to the Title Plan for XXXXXX. We understand this information is accessible to you from HM Land Registry.
Advice and Assistance: section 16 FOIA
Under our duty to provide advice and assistance in accordance with section 16 of the FOIA, we are able to provide the following information:
I can confirm Ordnance Survey conducted a survey on behalf of HM Land Registry on XX XXXXXX XXXX under Title Number XXXXXX. The full survey report was then sent directly back to HM Land Registry. A survey report usually consists of a word document that details the factual evidence of ground situations, along with an annotated plot and photographs to correspond with this report; this information is then used by HM Land Registry for the Title Plan. Ordnance Survey do not make any changes to Title Plans, HM Land Registry uses Ordnance Survey mapping to provide a representation of where a property’s boundaries are located.
The survey report will need to be obtained direct from HM Land Registry, quoting the relevant title number. We understand you can apply for an official copy of the report, by visiting the Land Registry website, section 4. Get a copy of the deeds and completing form OC2. The Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.
The Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
