Derived Data Exemption Requests

This Freedom of Information request concerns the Derived Data Exemption Requests from 2010 - 2015

Request for information – FOI16642


Thank you for your email of 11 February 2016, requesting the following information from Ordnance SUrvey in accordance with the Freedom of Information Act (FOIA) 2000:

Please provide me with a schedule (preferably in a tabular format e.g. .csv or .xlsx) of all Derived Data Exemption Requests received between 2010 and 2015 to include:

  1. Requesting Organisation (or a unique identifier)
  2. Date of request
  3. Summary of request
  4. Date of decision
  5. Approved or Rejected
  6. Reason for rejection

Our response

I can confirm that Ordnance Survey does hold some of the information you have requested.  Where the information is not held, this is stated.

The exemptions process was first introduced in Ordnance Survey on 1st April 2011.  Therefore, information prior to this date does not exist.

Please note the following:

  1. Requesting Organisation (or a unique identifier) – see Column 1 of the spreadsheet.
  2. Date of request – see Column 3 of the spreadsheet.
  3. Summary of request – see Column 2 of the spreadsheet. 
  4. Date of decision – see Column 5 of the spreadsheet. Note that where it is stated ‘streamlined (no decision)’, the request was submitted as part of the streamlined exemptions process and no decision was required.
  5. Approved or Rejected – See Column 4 of the spreadsheet. Note that where this is blank, the request was part of the streamlined exemptions process.
    Information in response to question (6) above is not held as the reason for each rejection is bespoke to each request and is not included in the enclosed spreadsheet.

However, under our duty to provide advice and assistance in accordance with S16 of the FOIA, please note that where an exemption request has been rejected, this will be because it was considered that the risk of release of the dataset, to OS or our partners, outweighed the positive impacts of a release of the dataset.

Internal review

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The FOI Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The FOI Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
