Our response

Thank you for your email of 6 August 2018. As your email is requesting information from Ordnance Survey in accordance with the Freedom of Information Act (FOIA) 2000 it has been forwarded to the Freedom of Information Officer to respond.

Having reviewed your email, Ordnance Survey addresses the following points raised in your letter. Please note we have extracted the questions from your letter and set them out below:

The land in question has been lawfully owned and occupied since 1898, when the property was built, a full "120 Years" history has been provided to the Land Registry, with ST1 from the owner 1990 – 2008 and the current owner 2008 – 2018, 28 years. The owner of xxxxxxxxxx, has no claim on land he does not physically occupy, but I find it interesting how the boundary has been moved physically on the master OS map by 3- 3.5m West to give him the land he has tried for 18 months to gain; placing a road through a National Monument?
This does not contain a valid request for information under the FOIA, as it does not include a specific request for recorded information, but instead makes a statement. However, under the duty to provide information and assistance in accordance with section 16 of FOIA, we can provide the following information which you may find useful.

Ordnance Survey mapping only shows the existence of physical features on the ground at the time of survey, surveyed to Ordnance Survey specification and published accuracy standards. Although some property boundaries may be coincident with surveyed map features, no assumptions should be made in these instances.

I am requesting under the Freedom Of information act 2000, and the Data Protection act 2018 (GDPR) for the following information.
Q1, has (1) of the following persons requested access to make or submit changes to the OS Master Map, and therefore had the Boundaries of xxxxxxx, xxxxxxx, xxxxxx, xxxxxx. Moved 3 to 3.5 m West, as the OS Surveyors map and information from the Land Registry clearly shows an illegal move of the boundaries of xxxxxx & xxxxxx: WEST

I confirm Ordnance Survey does not have a record of a request to make changes to OS MasterMap from any of the parties you refer to above.

Please note this request for information has been dealt with under the Freedom of Information Act 2000, as it is a request for recorded information. It is not a request for personal data therefore not deemed a subject access request under GDPR.

I am currently looking at Nimbus Maps and the OS Maps along with Land Registry Map search, all clearly show that the boundary has moved 3.5m West in to xxxxxxxxxx, so according to your information xxxxxxxxxx now belongs to xxxxxxxxxx. Please could you put this in writing so xxxxxxxxxx, can be claimed and occupied. Thank you.
We assume that this is a request directed at HM Land Registry however, in the event that it is for Ordnance Survey, we consider this does not contain a valid request for information under the FOIA, as it does not include a specific request for recorded information, instead, you are making a request for a statement to be made.

A meeting with the snr area OS manager is requested at xxxxxxxxxx for an answer as to how the master OS Map can be altered, 3-3.5m inaccurately, putting boundary 3.5m in to the next-door neighbour’s house.
Ordnance Survey were recently commissioned by HM Land Registry to complete a survey at xxxxxxxxxx under Title Number xxxxxxxxxx.  The site visit for this survey was completed by the OS surveyor on the 01/03/2018.   

Who checks the maps
Whilst this does not constitute a valid request for information held in a recorded form, we are able to provide the following information in accordance with our duty under section 16 of the FOIA to provide advice and assistance.

All production processes are subject to quality control (QC) procedures. With specific regard to large scale topographic updates by our Field surveyors we have a Field based manager and team that are responsible for QC. Following training and an extended period of consolidation of that training work undertaken by surveyors is sampled for inspection by that team. Once fully trained the QC sampling approach ensures regular checking but it is not against 100% of all data.  In addition to this we have a further check that is independent from QC. Our Quality Assurance team works to ensure that QC work is effective. Members of this team analyse a sample of the QC reports to ensure accuracy and consistency in reporting.

Internal review

Please include the reference number above. You may request an internal review where you believe Ordnance Survey has:

  • Failed to respond to your request within the time limits (normally 20 working days)
  • Failed to tell you whether or not we hold the information
  • Failed to provide the information you have requested
  • Failed to explain the reasons for refusing a request
  • Failed to correctly apply an exemption or exception

The Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
