Catering FM Contract

This Freedom of Information request asks for details of the catering facilities and catering contract.

Thank you for your email of  20 February 2020 requesting information from Ordnance Survey in accordance with the Freedom of Information Act (FOIA) 2000, as set out in the extract below:

  1. Is a catering restaurant or café provided on the premises?
  2. What are the addresses of the buildings in which the restaurants or cafés are located?
  3. Who is the current catering incumbent of the catering contract?
  4. What is the catering value? (Or is it nil subsidy?)
  5. Are the catering facilities shared with other departments?
  6. When is the catering service contract due for re-tender?
  7. How will it be re-tendered?
  8. Is the contract part of a PFI?
  9. Is it part of an FM contract? (and if so, what services are also included in the contract?)
  10. Who provides the other soft FM services?
  11. Who will be the main person leading on the tender during the formal tender process?
  12. When will the tender notice be issued?
  13. Where will the tender notice be issued?
  14. When is the tender due for release?
  15. Is it on the CCS framework?
  16. Who in the department is responsible for the management of the contract?
  17. How many people are there on-site per day? 

Our response

I confirm that Ordnance Survey does hold some of the information you have requested.  Where the information is not held or exempt from disclosure this is stated. Taking each request in turn, I confirm the following:

1. Is a catering restaurant or café provided on the premises?

Yes

2. What are the addresses of the buildings in which the restaurants or cafés are located?

There is one restaurant and it is located at Explorer House, Adanac Drive, Southampton.

3. Who is the current catering incumbent of the catering contract?

CBRE.

4. What is the catering value? (Or is it nil subsidy?)

Nil subsidy.

5. Are the catering facilities shared with other departments?

No.

6. When is the catering service contract due for re-tender?

June 2021 award, but may be part of total FM provision.

7. How will it be re-tendered?

Not held, this is to be confirmed.

8. Is the contract part of a PFI?

No.

9. Is it part of an FM contract? (and if so, what services are also included in the contract?)

I confirm it is part of the total FM contract, the other services included are Hard FM, Soft FM, security and cleaning.

10. Who provides the other soft FM services?

CBRE.

12. Who will be the main person leading on the tender during the formal tender process?

I confirm Ordnance survey holds the name of the person(s) requested above but this information is exempt from disclosure under section 40(2) (personal information) of the FOI Act, as the information constitutes personal data which is not already in the public domain.  

Section 40(2) provides that personal data is exempt information if one of the conditions set out in section 40(3) is satisfied. In our view, disclosure of this information would breach the data protection principles contained in the General Data Protection Regulations and Data Protection Act 2018.    

In reaching this decision, we have particularly considered:     

  • the reasonable expectations of the employees; given their positions, Ordnance Survey considered that none of the individuals would have a reasonable expectation that their personal data would be disclosed;   
  • the consequences of disclosure; and   
  • any legitimate public interest in disclosure.   

Section 40(2) is an absolute exemption and therefore not subject to the public interest test.  

However, under the duty to provide information and assistance in accordance with section 16 of FOIA, we can provide the following information which may assist you in this matter.

Not held. To be confirmed though it is likely to be mid-2020.

13. Where will the tender notice be issued?

Not held. The strategy is to be confirmed.

14. When is the tender due for release?

Not held. To be confirmed though it is likely to be mid-2020.

15. Is it on the CCS framework?

Not held. The strategy is to be confirmed.

16. Who in the department is responsible for the management of the contract?

The Facilities team is responsible for the management of the contract. The name of the person(s) is exempt from disclosure under section 40(2) as explained in question 11 above.

17. How many people are there on-site per day?

Circa 600-700.

Internal review

The Internal Review Officer will not have been involved in the original decision. They will conduct an independent internal review and will inform you of the outcome of the review normally within 20 working days, but exceptionally within 40 working days, in line with the Information Commissioner’s guidance.

The Internal Review Officer will either: uphold the original decision, provide an additional explanation of the exemption/s applied or release further information, if it is considered appropriate to do so.
